4. How we use your information and our lawful basis
Data protection law says we must have a lawful basis for each way we use personal information. The table below sets out what we do and why.
| What we use your information for | Our lawful basis |

Where we rely on legitimate interests, we have balanced our interests against your rights and freedoms. You can ask us for more information about this, and you have the right to object (see section 10).
5. Children and young people
Many people who take our placement test are students, and some are under 18. We take extra care with their information:
- Students can take a test without creating an account, and we only ask for the information needed to give and record a result.
- Results from a class test are shared only with the teacher who booked it.
- We do not send marketing to anyone we know to be under 18, and we do not use students' information for advertising or profiling.
- We have written this policy so that it is as clear as possible. Students who have questions should ask their teacher or a parent, or contact us.
Schools and teachers who book class tests should make sure their students, and where appropriate their parents or guardians, know that they are taking the test and that the teacher will see their results.
6. How your placement test level is worked out
Your Anglia level is worked out automatically from your answers. It is a recommendation to help you and your teacher choose the right exam level. It does not, on its own, make any decision that has a legal or similarly significant effect on you, such as whether you can sit an exam. Teachers should use it together with their own judgement. If you think your result is wrong, please contact us.
7. Who we share your information with
We never sell your personal information. We only share it when we need to, with:
- the teacher or school who booked your class test, who can see your name, answers, score and level;
- Chichester College Group, our parent organisation, which provides some of our IT, data protection and administration services;
- service providers who help us run the website, such as our website hosting provider (Krystal Hosting), our email delivery service and Google (for analytics and reCAPTCHA spam protection). They may only use your information on our instructions and must keep it secure; and
- professional advisers, regulators, the police or other authorities where the law requires it, or where it is needed to protect the rights, property or safety of Anglia, our users or others.
8. International transfers
The website is hosted in the United Kingdom, and people from many countries use it. Some of our service providers, such as Google, may process information outside the UK. When this happens, we make sure appropriate safeguards are in place, such as a UK adequacy decision, the UK International Data Transfer Agreement, or the UK Extension to the EU-US Data Privacy Framework.
9. How long we keep your information
We keep personal information only for as long as we need it. After that we delete it, or make it anonymous so that it can no longer identify anyone.
| Information | How long we keep it |
|---|---|
| Placement test results (individual tests) | 18 months from the date of the test, then anonymised |
| Class test bookings and results | 2 years from the date of the test, then anonymised |
| Teacher and registered user accounts | While your account is active. We delete accounts that have not been used for 2 years, after warning you by email |
| Messages and enquiries | 2 years from our last contact with you |
| Marketing preferences | Until you unsubscribe. We then keep a record that you have opted out, so that we do not contact you again |
| Server logs and security records | 90 days unless required to look into a security problem |
You can close your account at any time by contacting us. Anonymised results may be kept for longer to help us improve the test.
10. Your rights
Under data protection law, you have the right to:
- access your personal information and receive a copy of it;
- rectification: ask us to correct information that is wrong or incomplete;
- erasure: ask us to delete your information in some circumstances;
- restrict how we use your information in some circumstances;
- object to us using your information where we rely on legitimate interests, and to direct marketing at any time;
- data portability: receive information you have given us in a format you can reuse; and
- withdraw your consent at any time, where we rely on consent. This does not affect anything we did before you withdrew it.
To use any of these rights, contact our Data Protection Officer (see section 13). We will not charge you, and we will reply within one month. We may need to ask you for proof of identity before we act on a request.
If you are a student who took a class test, you can also ask your teacher about the results they hold.
11. How we keep your information safe
We use appropriate technical and organisational measures to protect your information. These include encrypted connections (HTTPS) across the website, encrypted passwords, access controls so that staff and teachers can only see the information they need, regular software updates and backups, and data protection training for our staff.
No website can be completely secure. If we become aware of a security breach that puts your information at risk, we will tell you and the Information Commissioner's Office where the law requires us to.
12. Changes to this policy
We may update this policy from time to time, for example when we add a new service to the website or the law changes. The date at the top shows when it was last updated. If we make important changes, we will let account holders know by email or through the website.
